The Problem of Performance Insecurity: Adopting the Doctrine of Anticipatory Non-Performance into UAE Law

The thesis undertakes a doctrinal-comparative study of the doctrine of anticipatory non-performance of contract and examines whether the doctrine should be adopted into the domestic law of the United Arab Emirates. This doctrine is concerned with the situation where one party to a contract faces a material increase in the risk that the promised performance by the other party will not be forthcoming by the due date for performance. The thesis utilises a mixed-sample of legal systems to propose a model of anticipatory non-performance and remedial regime that would accord with international practice and be compatible with UAE law.
