Mediating Constitutionalism and Religion: The Place of Islamic Law in Indonesian Constitutionalism

This thesis addresses the problem of the justifiability of the state support of religion and the adoption of Islamic law, by focusing on Indonesian constitutionalism. On the basis of the models of the relationships between state and religion, the thesis undertakes the doctrinal and historical analysis of the Preamble to the Indonesian Constitution, the constitutional articles, and the decisions of the Indonesian Constitutional Court. The thesis advances the arguments regarding the model adopted by the Constitution and whether the interpretation of the Constitutional Court is consistent with this model.
