Law and Dignity for Refugees in India: Examining the role of the Supreme Court

This thesis explores refugee rights in India through the lens of human dignity. It examines the role of the Indian Supreme Court in applying its progressive interpretation of dignity, particularly in relation to the fundamental right to life under Article 21 of the Constitution, to refugees as a marginalised community. It contends that dignity has played a pivotal role in the Court's human rights decisions and is similarly essential in recognising the constitutional rights of refugees in India. This research contributes to the ongoing discourse on refugee rights by critically evaluating the law through ongoing constitutional legal claims of refugees.
