This thesis explores Australia’s externalised migration control policies in Southeast Asia, with a specific focus on Australia’s cooperation with Indonesia in stopping the onward movement of asylum seekers to Australian shores. With reference to extraterritorial jurisdiction and the law of State responsibility, this thesis considers whether Australia can be held legally responsible for the human rights violations faced by refugees in Indonesia through its complicity in Indonesia’s border controls.
