Administrative Law and Public-Private Partnerships: A Comparative Analysis of India and England

Public-Private Partnerships (PPPs) are entities that provide public infrastructure services. This thesis examines whether administrative law, especially judicial review and freedom of information (FOI), applies to PPPs in India and England. Often, ‘public’ is distinguished from ‘private’ to apply administrative law to the former but not to the latter. The thesis undertakes a comparative analysis of how that distinction is made in applying judicial review and FOI laws in the two jurisdictions. The thesis develops an understanding of the relevant principles that are helpful in explaining, and also anticipating, how public-private distinctions are/will be made in the two jurisdictions.
