Good Faith: where are we at?

Her Honour considers whether a term of good faith in a contract can be implied in fact or in law with reference to the Victorian position on the issue. Her Honour also considers whether the duty of good faith can be excluded or waived through contract. Finally, Her Honour discusses the susceptibility of certain types of contracts to an obligation of good faith.
