Her Honour discusses the importance of judicial independence, its connection with the rule of law and how it interplays with the protection and enforcement of human rights. Her Honour also contrasts the manner in which the separation of powers doctrine is recognised and applied on the federal level compared to the state level. Additionally, Her Honour discusses the challenges associated with the court governance model used in Victoria in relation to judicial independence. Finally, Her Honour explains the relevance of judicial independence to sentencing and explores the meaning of judicial independence from different perspectives.
