Her Honour discusses the relevant measures which the Victorian Supreme Court has already taken to promote and preserve Australia and Victoria’s standing as a centre for commercial activity and foreign investment. Her Honour also explains how the conduct of commercial litigation and arbitration in Victoria can be further improved, noting the relevance of the Civil Procedure Act 2010 (Vic), the importance of consistency in arbitration and the Productivity Commission’s recommendations in relation to litigation funding and costs.
