《宗教事务条例》解读

发展中国家特色社会主义宗教理论 全面提高新形势下宗教工作水平

2017年8月26日,国务院总理签署国务院令,公布了新修订的《宗教事务条例》,自2018年2月1日起施行。宗教工作在党和国家工作全局中具有特殊重要性,关系中国特色社会主义事业发展,关系党同人民群众的血肉关系,关系社会和谐,民族团结,关系国家安全和祖国统一。

修订《宗教事务条例》的重要意义

1. 修订《条例》是深入落实习近平总书记重要讲话精神和全国宗教工作会议精神的重要举措。有利于更好地保障公民的宗教信仰自由权利,切实加强对宗教事务的依法管理,进一步提高宗教工作法治化水平,标志着我国宗教工作法治建设迈上了一个新台阶。

2. 进一步保障了公民宗教信仰自由。

规定各级人民政府应当为宗教团体、宗教院校和宗教活动场所可以依法申请法人登记;宗教团体、宗教院校和宗教活动场所依法享有相关财产权利。

3. 提出要进一步促进宗教和睦与社会和谐。

规定县级以上人民政府宗教事务部门依法对涉及国家利益和社会公共利益的宗教事务进行管理;信教公民和不信教公民、信仰不同宗教的公民应当相互尊重、和睦共处;各宗教坚持独立自主自办的原则;任何组织或者个人不得在不同宗教之间、同一宗教内部以及信教公民与不信教公民之间制造矛盾与冲突。

4. 进一步规范了宗教事务管理。

提出“保护合法、制止非法、遏制极端、抵御渗透、大经济犯罪”的原则,加强对宗教财产的监督管理、规范互联网宗教信息服务等。《条例》还明确了相关法律责任。

《条例》修订的着重点是什么

条例修订主要着眼六个方面,具体来说就是“两维护”“两明确”“两规范”。两维护,即维护公民宗教信仰自由和宗教界合法权益、维护国家安全和社会和谐。两明确,即明确宗教活动场所法人资格和宗教财产权属、明确遏制宗教商业化倾向。两规范,即规范宗教界财务管理、规范互联网宗教信息服务。

1 不能利用宗教危害国家安全。新《条例》继续基于对宗教问题的国际性、群众性、长期性、复杂性、民族性等“五大”特性的认识,针对极端宗教势力对国家安全的威胁,在新《条例》中规定任何组织或者个人不得利用宗教进行危害国家安全的活动,不得宣扬、支持、资助宗教极端主义,不得利用宗教破坏民族团结、分裂国家和进行恐怖活动。

2 宗教教育有法可依。在新《条例》中,明确和增加了有关宗教院校的相关内容,对宗教院校的教育体系、批准单位、办校原则等,制订了更多规范性条款。

3 互联网传教有章可循。新《条例》增加了互联网宗教信息服务的相关规定。今后在网上从事宗教服务,必须经省级以上人民政府宗教事务部门审核同意,还要按国家互联网信息服务管理有关规定办理正规手续。擅自从事互联网宗教信息服务或者超出批准或备案项目提供服务的,由有关部门根据相关法律、法规处理。

4 宗教资产要依法管理。新《条例》对宗教资产管理、特别是涉及宗教资产的税收等规范,纳入了宗教事务之中,这对加强宗教资产的依法管理,具有开拓性意义。

5 精准定义宗教活动场所职能。宗教活动场所审批、建设、修缮、内部管理等均有法可依。可有效避免各部门相互扯皮、宗教场所功能转移等问题。

6 宗教活动中所涉及的公共事务有人管了。在新《条例》中,规范了对于涉及非纯宗教信仰性的事务,应当由政府宗教事务主管部门会同相关的政府其他部门,共同协调、协商决定。这一规定,事实上是将宗教事务分作一般公共事务与纯粹宗教信仰事务两部分,对于宗教事务的管理,更为全面、更为有效。

7 宗教界合法财务受保护。任何组织或者个人不得侵占、哄抢、私分、损毁或者非法查封、扣押、冻结、没收、处分宗教团体、宗教院校、宗教活动场所的合法财产,不得损毁宗教团体、宗教院校、宗教活动场所占有、使用的文物。类似非宗教机构抢庙产、抢寺院土地等事件可以有效避免了。

8 爱国宗教团体开展工作师出有名。新《条例》对爱国宗教团体的职能,进行了相应规范,这为宗教团体明确自身职能、加强自身建设,提供了基本的法规保障。

Interpretation of the Regulations on Religious Affairs

Socialist Religious Theory with Developing Country Characteristics Comprehensively Improving Religious Work in the New Situation

On 26 August 2017, the Premier of the State Council signed a State Council Decree promulgating the newly revised Regulations on Religious Affairs, which came into effect on 1 February 2018. Religious work is of special importance in the overall work of the Party and the State, and is related to the development of the socialist cause with Chinese characteristics, the flesh-and-blood relationship between the Party and the people, social harmony, national unity, national security and the unification of the motherland.

The importance of amending the Regulations on Religious Affairs

1. The revision of the Regulations is an important step to thoroughly implement the spirit of General Secretary Xi Jinping's important speech and the spirit of the National Conference on Religious Work. It is conducive to better safeguarding citizens' right to freedom of religious belief, effectively strengthening the management of religious affairs in accordance with the law, and further improving the level of rule of law in religious work, marking a new step in the construction of the rule of law in China's religious work.

2. further safeguards citizens' freedom of religious belief.

It is stipulated that people's governments at all levels shall provide that religious groups, religious institutions and places of religious activities may apply for the registration of legal persons in accordance with the law; and that religious groups, religious institutions and places of religious activities shall enjoy relevant property rights in accordance with the law.

3. proposes to further promote religious harmony and social harmony.

It is stipulated that the religious affairs departments of the people's governments at or above the county level shall, in accordance with the law, manage religious affairs involving the interests of the State and the public interest of society; that citizens who are believers and those who are not, and those who believe in different religions shall respect each other and live together in harmony; that all religions shall adhere to the principle of independence, autonomy and self-administration; and that no organization or individual shall create contradictions and conflicts between different religions, within the same religion, or between citizens who are believers and those who are not. 4. further regulate the administration of religious affairs

4. The administration of religious affairs is further regulated.

It sets out the principles of "protecting the lawful, suppressing the unlawful, curbing extremism, resisting infiltration, and increasing economic crime", strengthens the supervision and management of religious property, and regulates religious information services on the Internet. The Regulations also clarify the relevant legal responsibilities.

What is the focus of the amendments to the Regulations?

The amendments to the Regulations focus on six areas, specifically "two safeguards", "two clarifications" and "two regulations". The two safeguards are to protect citizens' freedom of religious belief and the legitimate rights and interests of religious communities, and to maintain national security and social harmony. Two clarifications, namely, to clarify the legal personality of religious activity sites and the ownership of religious property, and to clearly curb the tendency of commercialisation of religion. Two norms, namely, to regulate the financial management of religious communities and to regulate religious information services on the Internet.

1. Religion cannot be used to endanger national security. The new Regulations continue to be based on an understanding of the "five major" characteristics of religious issues, including their international, mass, long-term, complex and ethnic nature, and address the threat to national security posed by extremist religious forces. sponsor religious extremism, and may not use religion to undermine national unity, split the country or carry out terrorist activities.

2. Religious education is now based on law. The new Regulations clarify and increase the content of religious colleges and universities and lay down more regulatory provisions on the education system, approved units and principles of running religious colleges and universities.

3. There are rules and regulations for the preaching of religion on the Internet. The new Regulations have added provisions relating to religious information services on the Internet. In the future, religious services on the Internet must be reviewed and approved by the religious affairs department of the people's government at or above the provincial level, and formal procedures must also be carried out in accordance with the relevant regulations on the management of national Internet information services. Anyone who engages in religious information services on the Internet without permission or provides services beyond the approved or recorded items shall be dealt with by the relevant authorities in accordance with relevant laws and regulations.

4. Religious assets are to be managed in accordance with the law. The new Regulations have incorporated norms on the management of religious assets, especially taxation involving religious assets, into religious affairs, which is of pioneering significance in strengthening the management of religious assets in accordance with the law.

5. Precise definition of the functions of religious places of worship. The approval, construction, repair and internal management of places of religious activities are all governed by law. It can effectively avoid problems such as departments  shifting of responsibilities and changing the functions of religious sites.

6. The public affairs involved in religious activities are now managed. In the new Regulations, it is regulated that for matters involving non-purely religious beliefs, they should be coordinated and decided by the government department in charge of religious affairs, in conjunction with other relevant government departments. This provision, in effect, divides religious affairs into two parts: general public affairs and matters of purely religious beliefs, and provides for more comprehensive and effective management of religious affairs.

7. The lawful finances of religious communities are protected. No organisation or individual may appropriate, loot, share, destroy or illegally seize, seize, freeze, confiscate or dispose of the lawful property of religious bodies, religious institutions or places of religious activities, or damage cultural relics in the possession or use of religious bodies, religious institutions or places of religious activities. Incidents similar to the robbery of temple property and temple land by non-religious institutions can now be effectively avoided.

8. Patriotic religious groups have a reputation for carrying out their work. The new regulations specifies the functions of patriotic religious groups, which provide basic legal safeguards for religious groups to clarify their functions and strengthen their own construction.
