The prosecution of corporations in Australia

thesis
posted on 2017-02-08, 03:53 authored by Clough, Jonathan
This thesis is based on previously published and unpublished material. It seeks to comprehensively and critically analyse the law relating to the prosecution of corporations in Australia. It encompassed the key aspects of any prosecution: the rationale for criminal liability, the investigation of corporate crime, criminal procedure, models of liability (both statute and common law) and sentencing options. Although focussing on the law of Australia, this thesis draws upon comparative legal materials from the United States, the United Kingdom, Canada and New Zealand.
